KUBRA is committed to protecting your privacy and developing technology that gives you the most powerful and safe online experience. This Statement of Privacy applies to the KUBRA website and governs data collection and usage. By using the KUBRA website, you consent to the data practices described in this statement.

 Collection of Personal Information

KUBRA may collect personally identifiable information, such as your email address, name, home or work address or telephone number. KUBRA may also collect anonymous demographic information, which is not unique to you, such as your ZIP code, age, gender, preferences, interests and favorites.

There is also information about your computer hardware and software that is automatically collected by KUBRA. This information can include: your IP address, browser type, domain names, access times and referring website addresses. This information is used by KUBRA for the operation of the service, to maintain quality of the service, and to provide general statistics regarding use of the KUBRA website.

Please keep in mind that if you directly disclose personally identifiable information or personally sensitive data through KUBRA public message boards, this information may be collected and used by others. Note: KUBRA does not read any of your private online communications.

KUBRA encourages you to review the privacy statements of websites you choose to link to from KUBRA so that you can understand how those websites collect, use and share your information. KUBRA is not responsible for the privacy statements or other content on websites outside of the KUBRA and KUBRA family of websites.

Use of Personal Information

KUBRA collects and uses your personal information to operate the KUBRA website and deliver the services you have requested. KUBRA also uses your personally identifiable information to inform you of other products or services available from KUBRA and its affiliates. KUBRA may also contact you via surveys to conduct research about your opinion of current services or of potential new services that may be offered.

KUBRA does not sell, rent or lease its customer lists to third parties. KUBRA may, from time to time, contact you on behalf of external business partners about a particular offering that may be of interest to you. In those cases, your unique personally identifiable information (email, name, address, telephone number) is not transferred to the third party. In addition, KUBRA may share data with trusted partners to help us perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. All such third parties are prohibited from using your personal information except to provide these services to KUBRA, and they are required to maintain the confidentiality of your information.

KUBRA does not use or disclose sensitive personal information, such as race, religion, or political affiliations, without your explicit consent.

KUBRA keeps track of the websites and pages our customers visit within KUBRA, in order to determine what KUBRA services are the most popular. This data is used to deliver customized content and advertising within KUBRA to customers whose behavior indicates that they are interested in a particular subject area.

KUBRA websites will disclose your personal information, without notice, only if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on KUBRA or the site; (b) protect and defend the rights or property of KUBRA; and, (c) act under exigent circumstances to protect the personal safety of users of KUBRA, or the public.

For example, if you personalize KUBRA pages, or register with KUBRA site or services, a cookie helps KUBRA to recall your specific information on subsequent visits. When you return to the same KUBRA website, the information you previously provided can be retrieved, so you can easily use the KUBRA features that you customized.

KUBRA secures the personally identifiable information you provide on computer servers in a controlled, secure environment, protected from unauthorized access, use or disclosure. When personal information (such as a credit card number) is transmitted to other websites, it is protected through the use of encryption, such as the Secure Socket Layer (SSL) protocol.

KUBRA will occasionally update this Statement of Privacy to reflect company and customer feedback. KUBRA encourages you to periodically review this Statement to be informed of how KUBRA is protecting your information.

ADDITIONAL INFORMATION FOR CALIFORNIA RESIDENTS 

Under California law, specific disclosures are required and California residents have additional rights regarding their personal information. Please review this section to learn more.

Residents of California may have the following rights:

1.  Right to access your personal information.  You may request to access the categories and specific pieces of personal information that we collected about you in connection with your use of the KUBRA website. 

2.  Right to deletion.  Subject to certain exceptions, you may ask us to delete the personal information we collected about you in connection with your use of the KUBRA website. 

3.  Right to disclosure.  You may request to receive additional details about the sources from which we collect your personal information, the reasons we collect and share your personal information, and the types of third parties with which we share the information we collected about you in connection with your use of the KUBRA website.

4.  Right to opt out of sales.  Under the CCPA, certain types of sharing of personal information may constitute a “sale” of your personal information. KUBRA does not “sell” the personal information we collected about you in connection with your use of the KUBRA website.

5.  Right to be free from discrimination.  You may exercise any of the above rights without fear of being denied goods or services, including access to the Tools.  We are permitted to provide a different level of service or charge a different rate if the difference is reasonably related to the value of your data.

Please note that KUBRA is not responsible for the data handling practices of the utilities, insurance companies, government agencies and other service providers for which you may use the KUBRA Services as a payment platform (i.e., the Service Providers).  If you want to exercise your CCPA rights with respect to the personal information the Service Providers collect and maintain about you, you will need to contact them directly to exercise your CCPA rights.

Your Shine the Light California Rights (CA Civil Code § 1798.83)

Residents of California may request a list of third parties to which certain personal information (as defined by applicable California law) obtained through the KUBRA website and disclosed by KUBRA during the preceding year for those third parties’ direct marketing purposes. If you are a California resident and want such a list, please write to us at 40 E Rio Salado Pkwy, Suite 535, Tempe, AZ, 85281. For all requests, you must put the statement “Your California Privacy Rights” in the body of your request, as well as your name, street address, city, state, and zip code. In your request, you need to attest to the fact that you are a California resident and provide a current California address for our response. Please note that we will not accept requests via other contact channels, and we are not responsible for notices that are not labeled or sent properly, or that do not have complete information. 

Do Not Track 

KUBRA does not currently take steps to respond to browsers “Do Not Track” signals as no uniform standard to respond to such signals has been developed at this time. 

Supplemental Notice to European Union (“EU”) Residents

1. Lawful Grounds

If you are a resident of the EU, this notice describes how KUBRA acts in accordance with the General Data Protection Regulation (“GDPR”). KUBRA relies on legitimate interest to process your data for the purposes described in the Use of Personal Information section above.

2. Transfer of Data

KUBRA operates its Services from the United States and Canada, meaning your personal data may be transferred to the US, Canada and/or to countries outside of the EU. Whenever your personal data is transferred outside the EU, KUBRA will take all reasonable steps necessary to ensure the data is secure and treated in accordance with KUBRA’s privacy policy.

Where required by the GDPR, appropriate safeguards, such as the standard contractual clauses approved by the European Commission will be put in place.

3. Right to Withdraw Consent

In the circumstance where KUBRA may require your consent in processing your personal data, you have a right to withdraw your consent for such processing at any time. To withdraw your consent, please contact us at privacy@kubra.com. Once your withdrawal notification is received, KUBRA will no longer process the information for the specific purpose(s) for which the original consent was given, unless it is done for a legal basis.
